First of all, it is important to clarify the following, since it is obvious that you have not made an effort to verify or understand the current status of the complaints you have filed relating exclusively to me. In all legal proceedings that have been initiated by you in which I am mentioned and in which the appropriate authorities have notified me or in which I have been legally notified that they require my presence, I have fully complied within the terms of the Laws of our State.
Regarding what you have said, the legal evidence and documentation are irrefutable, and those that are within my reach will be made known to you and the public at the appropriate time and when the authorities authorize me to do so. I invite you as Cara Singleton’s attorney to do the same and that you finally show the evidence that you say you have that proves that I am involved in any wrong doing against Ms. Cara Singleton. It should be known that our Mexican legal system establishes that proof must be objective and not subjective, in other words, one must offer proof through existing elements and not acts of imagination or sentiment.
Mr. Payton, the contents of the full page ad you published, which was also communicated on a massive scale in the newspaper with the largest circulation in our state and beyond, as well as in electronic media (Internet), you seem to be confused. You make reference that Amerimex Realty and myself are responsible for making this matter public by initiating this dynamic. In this regard I would like to remind you that it was your client Ms. Cara Singleton, also known as Carol Suzanne Singleton (different names she uses at her convenience), who decided to elaborate and publish a web page called www.kingsofcabo.com, a Facebook page also known as Kings of Cabo and a video known as KINGS OF CABO, a Fight for Justice in Baja Sur, and in which she explains her situation and makes accusations without the consent of Amerimex Realty or myself. So you see, there were three actions taken in public forums or media, all undertaken prior to the communique published by Amerimex Realty. It is clear that neither said company or myself have had anything to do with initiating this dynamic. Furthermore, if you refer to the declarations of Amerimex Realty, it is clearly stated that said company is in no way involved in the matters pertaining to Ms. Cara Singleton and Alex Matijas, a fact that, up to this moment you have failed to contradict or refute.
I declare, as and how I have done so publically, that I have never refused to appear at any legal public hearing from any authority, moreover, attorney Peyton if you were paying attention to the files in this case you would know that I voluntarily participated in the investigation number LPZ/214/AMP9/2014, however, not as an accused but as a witness. No elements exist in the above referenced investigation that establishes a legitimate link of rights and obligations between Attorney John Moreno and Ms. Cara Singleton that would justify accusations against me. To that effect the numerous accusations of attorney Peyton are false, defamatory and slanderous. Apart from not offering a single element of proof to backup his claims, just having made a charge against someone is not proof of guilt.
Therefore, I want to tell the general public who have visited or heard of the internet page known as www.kingsofcabo.com or any publication or article that uses that site as a reference, and in which Ms. Cara Singleton tells the story of Ms. Cara Singleton and Mr. Alex Matijas, that they will note that in said presentation there is no mention that I had any relation or intervention in any contract or the dealings in question. And I’m sure you would agree that if any evidence of such intervention existed or of the accusations by the above referenced attorney directly accusing me of 1. Collusion; 2. To have received money from Ms. Cara Singleton; 3. Not being honorable 4. Not fulfilling agreements; 5. Having deceived Ms. Cara Singleton, and 6. That I have publically lied or made false statements; that such an invitation to present myself before the authorities would be completely unwarranted and unnecessary. All of which runs counter and contradicts the information that is presented in the afore mentioned Internet site, which contains the exclusive statements of Ms. Cara Singleton. Given these facts we can only assume that Attorney Peyton is not aware of his client’s public statements.
Further, it is an irrefutable fact and completely demonstrable that neither John Moreno or Amerimex Realty have entered into any sort of legal act or agreement with your client Ms. Cara Singleton, that neither have ever received even one cent from your client, and that neither have had any communication with or even knew Ms. Cara Singleton prior to July 4th, 2015 and have at no time engaged in illicit activities, acts or wrongdoing against her.
If you ask, “Why is it that in two years of criminal investigations, no arrest warrants have been issued?” It is logical to think that either you do not know our legal system or you have not been following the investigations, because to this day I have always cooperated with the authorities and they have seen no basis to issue any warrants or any measures of this nature, not, as you insinuated, because they are incompetent. Truth be told the current situation is due to a lack of objective evidence and the inefficiency of the legal efforts undertaken thus far, that you have not been able to obtain neither a positive nor tangible result to substantiate the rights of your client, and the claims which have been erroneously directed at me. It is quite obvious that you are frustrated and are now attempting strategies to use criminal complaints to pressure me, which has also not given the fruits you have desired or expected, simply because of lack of evidence. This in turn has motivated you to use the media with the only intention to defame, slander and discredit people without any regard for the truth, their rights and legal guarantees; these acts will also not bear fruit and directly contradict what your own client Ms. Cara Singleton has publicly stated. In my opinion, it is quite evident that your publications (campaign) are being endorsed by a certain illicit tourism developer; I conclude this by simple logic and the sense of the timing and opportunity to take advantage of the situation.
In that light, and out of respect for the people of our State we should be honest and sincere, and be clear as to what is really going on. Its important to me to point out that what has been happening to me is that I have been targeted and have become the object of ruthless attacks, defamation, and a smear campaign by elements in both the private sector as well as the public sector, maximized and promoted by the media without any evidence and without granting the right to defend myself, all with the sole objective to destroy me, figuratively speaking that is. The purpose of this is to use me as a living example of what will happen to those who dare to raise their voice against injustice and defend the rights and dignity of the people against greedy and predatory interests, in spite of the fact that I have always acted within the Law. I want to be emphatic in saying that these practices are incompatible with a modern democratic and progressive State that is respectful of the human rights of it’s inhabitants.
Attorney Peyton, regarding the second to the last paragraph in the full page ad that you published, if you read the webpage www.kingsofcabo.com, where your client specifies the bank account number and the person to whom she transferred the funds, you will observe that I am not the receiver nor the owner of the bank account to which she refers; no further comment being required in this regard.
In closing, I would like to thank all the people who have taken the time to read and find out the truth about this matter from reliable sources, all those who have expressed your support for me and your indignation and complete rejection of the attacks to which I have been subjected.
